China is Strongly Condemned

For Its Defiance of the Dignity of Humankind

As we all know, a great many Koreans are defecting from North Korea to China today. If caught, they are severely punished within their homeland. They are often sent to secret concentration camps for life or executed. Despite such extraordinary risks, they continue to flee North Korea for food and freedom.

 

International society and humanitarian laws have developed to the point that recognition of their rights and need for protection as refugees is virtually universal. The United Nations High Commission for Refugees (UNHCR) was created almost 60 years ago and given this specific mandate and has since been protecting tens of millions of refugees all over the world under the international law. The reality is that the UNHCR is protecting over 30 million refugees all over the world right at this very moment. Accordingly, North Korean defectors, like all other defector under the fear of persecution and harsh reprisal, must be protected as their eligibility for refugee status under the 1951 Refugee Convention is clear and unequivocal.  

 

Nonetheless, in utter defiance of international law and the norms of international society, the government of China arbitrarily refuses to recognize North Korean defectors as refugees on their soil. One would be hard-pressed to find another situation of comparable circumstances as those of the North Korean refugees in which escapees are not readily recognized as refugees. China stands alone in its blatant refusal to recognize North Korean defectors as refugees.

 

Whether North Korean defectors in China are refugees or not is a question to be determined by international instruments, not by the national law of China. Repeatedly, China has officially paid lip-service to the assertion that international laws will supersede its national laws in case of conflict. However, in actual practice, the government of China has continued the systematic  arrest of North Korean refugees in exclusive application of Chinese national law without objective and fair refugee determination procedures. Unquestionably, this is clearly an act of China¡¯s national hypocrisy that has resulted in a human tragedy of enormous magnitude.

 

The government of China has shamefully and consistently maintained the absurd argument that North Korean defectors are repatriated because they are not refugees. It is the expressed conscience and resolution of 21st Century humankind that refugees must be protected and that no refugees should be forcibly repatriated to their countries if there is a well-founded fear of persecution upon repatriation. The implausible Chinese argument notwithstanding, the universally recognized non-refoulement principle is a key pillar of all relevant international laws[1] to be applicable whether or not the victims have been formally recognized as refugees.¡±

 

Therefore, the Chinese policy of repatriating North Korean escapees on the grounds that they are not refugees, upon serious scrutiny, is simply groundless and is, indeed, an act of shame on the part of the government of China. What is even more shameful is the South Korean government and those of its citizens who do not voice their protest to the Chinese government when their own citizens are wrongly treated as beasts in China. In this respect, I must confess that I feel deeply embarrassed that I am a South Korean citizen.

 

Accordingly, the Chinese policy of forced repatriation of North Korean defectors is clearly a categorical violation of Non-Refoulement principle and an affront to  the conscience of humankind in this day and age.

 

Over the years, we, as members of the international community, have made a number of appeals and asked questions to the government of China on the issue of North Korean defectors in China.

 

The Chinese government has ignored these appeals, not bothering even to respond. It has instead continued to forcibly return North Korean refugees to their fate of atrocious persecution in North Korea. This is unquestionably a case of stiff-necked defiance of humanitarianism and of the international community by the Chinese government.

 

By these actions and positions, China is in effect saying, ¡°Who do you think you are, you little NGOs? I said ¡®No¡¯ and that means ¡®No!¡¯ So keep your mouths shut!!¡±  This is clearly a case of Chinese arrogance and defiance of international humanitarian principles, not a case of a simple difference of opinion or interpretation. It is a straightforward case of China defying humanity and the world community, a clear-cut case beyond any controversy.

 

Today, we no longer appeal to China for humanitarian consideration in relation to North Korean refugees. Instead, we strongly condemn the government of China for its defiance of the rule of law and the world community. Today, we ask the international community ¡°How long are we going to tolerate such defiance?¡± We are of the deep conviction that we must challenge Chinese arrogance once and for all. The continued turning of a blind eye by the international community to China¡¯s contempt for humanitarianism today can only serve to incubate the aspiring Hitlers and Stalins of tomorrow. 

 

Today we strongly demand that the People¡¯s Republic of China answer our question, ¡°On what grounds is China repatriating North Korean defectors in view of all the international instruments prohibiting forced repatriation to be applicable regardless of refugee status?¡±  This is a burning questions that is crucially relevant to China¡¯s international obligations and one which China has most shamefully, rudely and arrogantly ignored for far too long.

 

China! You must immediately stop forced repatriation of North Korean defectors to the fate of severe persecution. Otherwise, there can be no recourse but the payment of a dear price for defiance of international justice today.
